ഇതിനെ "മറുമക്കത്തായം" എന്നു വേണം പറയുവാൻ. ഈ അവകാശക്രമം ലോകത്തിൽ മറ്റെങ്ങും നടപ്പില്ല. ഈ നിയമപ്രകാരം ഒരുവൻ്റെ  സ്വത്തിനു അവൻ്റെ ഭാര്യയ്ക്കോ മക്കള്‍ക്കോ  അവകാശമില്ലാ. അവൻ മരിച്ചാൽ അവൻ്റെ ചരമകർമ്മങ്ങൾ നടത്തുവാനും അവൻ്റെ ആത്മരക്ഷയ്ക്കു വേണ്ടി പ്രാർത്ഥിക്കുവാനും മക്കൾക്ക് കാര്യമില്ലാത്രേ നമ്മുടെ സ്വത്തിൻ്റെയും ദേഹത്തിൻ്റെയും ഉടമസ്ഥന്മാർ നമ്മുടെ 'മറുമക്കൾ' എന്ന സഹോദരിമാരുടെ മക്കളും, ആ മക്കളിൽ സ്ത്രീകളായവരുടെ മക്കളും ആണ്. മക്കവഴിയിൽ പുരുഷന്മാർ വിവാഹം ചെയ്തു കുഡുംബത്തെ നില നിറുത്തുന്നതു പോലെ മരുമക്കവഴിയിൽ സ്ത്രീകൾ കുഡുംബത്തെ നിലനിറത്തുവാൻ സങ്കൽപ്പിക്കപ്പെട്ടവരാകുന്നു. .....കൊണ്ടു ഉല്‍കൃഷ്ടന്മാര്‍ എന്നു..... മറുമക്കത്തായം സൌകര്യം നല്‍കുന്നു. ആ സ്ത്രീകൾക്ക് യാതൊരു വിവാഹവും കൂടാതെ ജനിക്കുന്ന കുട്ടികൾക്ക് ആ സ്ത്രീകളുടെ തറവാട്ടിൽ അവകാശം സിദ്ധിക്കാതെ വരുകയില്ലാ. 

      മറുമക്കത്തായ കുഡുംബം പ്രത്യേകം മിശ്രമായ ഒരു മനുഷ്യയോഗം ആകുന്നു. അതിൻ്റെ അംഗങ്ങൾ പലവിധത്തിൽ ഛിദ്രിക്കപ്പെട്ടിരിക്കുന്നു. ആ കുഡുംബത്തിലുള്ള പുരുഷന്മാർ അവരുടെ ഭാര്യമാർക്കു വശപ്പെട്ട് സ്വത്തിനെ രക്ഷിക്കുന്നവരും, സ്വത്തിൻ്റെ അവകാശികളായ സ്ത്രീകൾ അവരുടെ ഭർത്താക്കന്മാർക്കു വശപ്പെട്ട് പ്രവർത്തിക്കുന്നവരും ആകക്കൊണ്ട്, ഒരു മറുമക്കത്തായ കുഡുംബത്തിൽ ഏക യോഗക്ഷേമത്തിന് അവകാശം ഇല്ലാ. ഒരു കുഡുംബത്തിൽ ഒരുമിച്ചു താമസിക്കുന്നവരായി സഹോദരീ സഹോദര ഭാവത്തിലും അമ്മയുടെയും കുട്ടികളുടെയും നിലയിലും പത്തും അമ്പതും നൂറും സ്ത്രീ പുരുഷന്മാരും അവരിൽ സ്ത്രീകളുടെ കുട്ടികളും ഉണ്ടാകും. ഇവരെ ഒക്കെ പുലർത്തേണ്ടത് കാരണവൻ്റെ ചുമതലയാകുന്നു. ഇവരെ കൂടാതെ, കാരണവരുടെ ഭാര്യയെയും മക്കളെയും അന്വേഷിക്കുന്നതും രക്ഷിക്കുന്നതും കാരണവൻ ബുദ്ധിഗുണമുള്ളവനായൽ ചെയ്യുന്ന ജോലിയാകുന്നു. പുരുഷന്മാർക്കു അവരുടെ ഭാര്യമാരെയും മക്കളെയും സംരക്ഷിക്കേണ്ട ചുമതല ഇല്ലാ. കുട്ടികളെ രക്ഷിക്കയും വിദ്യാഭ്യാസം ചെയ്യിക്കയും മറ്റു വിധത്തിൽ അവരെ അവർക്കു തന്നെ ഉപകരിക്കുന്നവരായി തീർക്കയും ചെയ്യുന്നതിന് കാരണവൻ കടപ്പെട്ടിരിക്കുന്നു. അനന്തരവർ, പുരുഷന്മാർ ആയിരുന്നാൽ അവരുടെ ഭാര്യമാർക്കും, സ്ത്രീകളായിരുന്നാൽ അവരുടെ ഭർത്താക്കന്മാർക്കും വശപ്പെട്ടു നടക്കുന്നവരായിട്ട്, കാരണവരെ കുഡുംബഭരണ ജോലിയിൽ സഹായിക്കാതെയും പല സന്ദർഭങ്ങളിലും അവർക്കും കുഡുംബക്ഷേമത്തിനും പ്രതികൂലമായി പ്രവർത്തിച്ചും കാണപ്പെടുന്നു. 

      'മറുമക്കത്തായ കുഡുംബം' എന്നാൽ ഒരു സ്ത്രീയും അവളുടെ കുട്ടികളും ആ കുട്ടികളിൽ പെണ്ണുങ്ങളായുള്ളവരുടെ കുട്ടികളും ഇങ്ങനെ സ്ത്രീവഴി പെരുകിയിട്ടുള്ള ഒരു മനുഷ്യയോഗം ആകുന്നു. മക്കവഴിയിൽ ഒരു കുഡുംബം എന്നത് ഒരു പുരുഷനും അവൻ്റെ ഭാര്യയും കുട്ടികളും മാത്രമാണ്. മറുമക്കവഴിയിൽ രക്ത സംബന്ധമായുള്ളതും ഇല്ലാത്തതും ആയ സഹോദരങ്ങളെയും അവരുടെ മക്കളെയും ഒരു കാരണവർ സംരക്ഷിക്കേണ്ടതാണ്. അതു കൂടാതെ പിതൃധർമ്മം അറിഞ്ഞിട്ടുള്ള കാരണവന് അവൻ്റെ ഭാര്യയെയും മക്കളെയും സംരക്ഷിക്കണ്ടതായുണ്ട്. ഇതിലേക്ക് വേണ്ട സ്വത്ത് കാരണവൻ്റെ കുഡുംബത്തിൽ നിന്നും എടുക്കേണ്ടി വരുമ്പോൾ അതിനെ തടയുന്നതിനും നിരാകരിക്കുന്നതിനും മറുമക്കൾക്ക് അവകാശമുണ്ട്. എന്തായാലും, മറുമക്കവഴി കുഡുംബത്തിൻ്റെ ഏകയോഗക്ഷേമം ആ കുഡുംബത്തിൽ സ്വത്തിനു അവകാശമില്ലാത്ത പല  സ്ത്രീപുരുഷന്മാരുടെ ഗുണദോഷങ്ങൾക്ക് വശപ്പെട്ടിരിക്കുന്ന പുരുഷന്മാരാലും സ്ത്രീകളാലും    ഛിദ്രിക്കപ്പെട്ട.... സംഗതിയാകന്നു. 

 മറുമക്കവഴി  ഏറ്റവും നിന്ദ്യമായിട്ടുള്ള ഒരു ഏർപ്പാടാകുന്നു. കെട്ടുകല്ല്യാണം മരുമക്കവഴി കുഡുംബങ്ങൾക്ക് അനർത്ഥോൽപാദകവും ജുഗുപ്സാവഹവും ആയ ഒരു ആദി ചടങ്ങാണല്ലൊ. ഇതുകൊണ്ട് ഒരു സ്ത്രീ ഭാര്യയായോ അവളെ കെട്ടുന്നവൻ ഭർത്താവായോ ഭവിക്കുന്നില്ലാ. അവൾക്ക് വേറെ പുരുഷനെ ഭർത്തവായി സ്വീകരിക്കുന്നതിന് സ്വാതന്ത്ര്യം ഉണ്ട്. എന്നാൽ, ഇതിൽ ഒരു ഹൈന്ദവ വിവാഹത്തിൻ്റെ ചടങ്ങുകൾ ഒക്കെ ആചാരിക്കപ്പെട്ടു കാണുന്നത് കൊണ്ട് ഇതിനെ സങ്കല്പം കൊണ്ടുള്ള ഒരു വിവാഹമായി തന്നെ ഗണിക്കണം. ആ സങ്കല്പം കൊണ്ട് പെൺകുട്ടി സ്ത്രീധർമ്മത്തെ ആനുഷ്ഠിക്കുന്നതിന് കടപ്പെട്ടവൾ എന്നു വരുന്നു. സാധാരണ മരുമക്കവഴി കുഡുംബത്തില്‍ ഈ കെട്ടുകല്ല്യാണം സ്ത്രീകളുടെ ചാരിത്രശുദ്ധിയെ നശിപ്പിക്കുന്നതിന് നൽകുന്ന സ്വാതന്ത്ര്യം ആയ് തീര്‍ന്നിരിക്കുന്നു. പരദേശങ്ങളിൽ ദാസിമാർ എന്നൊരു വക സ്ത്രീകൾ ഉണ്ട്. അവരുടെ വൃത്തി വ്യഭിചാരം ആണ്. അവർക്ക് സ്ഥിരമായ ഭർത്താവില്ലാ. വ്യഭിചാരത്താൽ ഉണ്ടാകുന്ന അവരുടെ കുട്ടികൾക്ക് അവരുടെ സ്വത്തിന് അവകാശം സിദ്ധിക്കുന്നു. അച്ഛനെ അറിയുവാനോ അച്ഛൻ്റെ സ്വത്തിനെ അവകാശപ്പെടുവാനൊ ആ ദാസിമാരുടെ വ്യഭിചാരത്തിൽ നിന്നും ഉണ്ടാകുന്ന കുട്ടികൾക്ക് അവകാശമില്ല. എന്നാൽ, ആ സ്ത്രീകൾക്കും കെട്ടുകല്ല്യാണം ആവശ്യമാണെന്ന് വിധിച്ചിരിക്കുന്നു. ആ മംഗല്ല്യധാരണം ചെയ്യുന്നതിനു മുമ്പേ അവർക്ക് വ്യഭിചാരത്തെ അവരുടെ വൃത്തിയായി സ്വീകരിക്കാൻ പാടില്ലത്രേ. മംഗല്ല്യധാരണം, അതായത്, നമ്മുടെ കെട്ടുകല്ല്യാണം, സ്ത്രീകൾക്ക് വ്യഭിചാരത്തിനായി അവകാശം നൽകുന്ന ഒരു അടിയന്തരത്തിൻ്റെ അവശിഷ്ടമാകുന്നു.

This should be called "the lineage of other children"(MaRumakkathayam).* This type of succession does not exist anywhere else in the world. According to this law, one’s wife or children have no right to his property. If one dies, there is no role for his children to perform his funeral rites and pray for his salvation. The owners of his property and even his body are the “other children” [MaRumakkal – nephews and nieces]* of his sisters and the children of those children who are female. Just like the men who marry and support the family in the lineage of one’s own children, the women are supposed to keep the family in Marumakkathayam. *****(text missing) that they are blessed with *****(text missing) and MaRumakkathayam gives them enough facilities. Children born out of wedlock to those women will indeed inherit the rights in their Tharavaad*. The MaRumakkathayam family is a particularly mixed group of people. Its members are divided in many ways. Since the men in that family are devoted to their wives and handle their property, and the women heirs to the property are devoted to their husbands, there is no right to a uniform family welfare in any MaRumakkathayam family. There will often be ten, 50, or even a 100 men and women, related as brothers and sisters, and children of those women living together in a single family. It is the responsibility of the Karanavar* to look after all of them. Apart from these, protection and upkeep of his wife and children is the task of a wise and capable Karanavar. The other men in the family have no such responsibility. The Karanavar is duty bound to protect and educate all the children and make them capable of leading a normal life. Some nephews and nieces in the family are found to be living dependent on their spouses, without even bothering to help the Karanavar in running the household. In many cases they are working against their own interests and the welfare of the family.

The ‘MaRumakkathayam family’ means a human assembly consisting of a woman and her children and the children of those female children, thus increasing their numbers through female lineage. Under the lineage of their own children system (Makkathayam), a family is just a man and his wife and their children. In MaRumakkathayam, a Karanavar should protect the blood relatives and other siblings and their children. Apart from that, a Karanavar who knows his fatherly duty has to protect his wife and children. If and when a Karanavar is to use the Tharavaad property for the upkeep of the family, the MaRumakkal (nephews and nieces) have the right to prevent him from doing so. In any case, the welfare of the family in the MaRumakkathayam became fragmented by the men and the women who were influenced by the merits and the demerits of those who had no right to property in that family. The MaRumakkal lineage is the most despicable arrangement.

Kettukallyanam* is an old, inauspicious, and despicable ceremony in the Marumakkathaya families. Through this marriage, a woman does not become a wife nor the man who weds her, a husband. She is free to accept another man as her husband. However, since all the rituals of a Hindu wedding are observed in this, it should be considered a marriage. In this concept, the girl is bound to practice her feminine duty. In the Marumakkathayam family, this type of marriage has become the license to destroy women's chastity.

In other regions, there are women who are known as slave girls. Their only work is prostitution. They do not have a permanent husband. The children born to these women are entitled to their property. Children born from adultery of those slave girls have no right to know their father or to claim their father's property. However, it is ruled that those women are also to perform Kettukalyanam. They should not accept adultery as their work before entering the wedlock. Mangallyadharanam* or Kettukalyanam is the remnant of a ceremony that entitles women to adultery.

*Tharavaad refers to a family consisting of all the descendants in the female line of one common female ancestor. The Nair regulation as well as the Malabar Marriage Act defines a Tharavaad as a joint family governed by the Marumakkathayam law of inheritance. Although the Tharavaad followed a matrilineal line, at the helm of it was the Karnavar (usually the eldest female family member's son or brother), who was the male head of the family. The women of the household would stay back in their maternal homes, while the men often relocated to their wives' houses.

* Karanavar is the eldest male member of the family.

* Kettukalyanam is a marriage rite performed while the girl is very young. A tali (gold chain) is tied around her neck by the male. Often, such a union is not permanent.
