 മരുമക്കത്തായ കുഡുംബങ്ങളില്‍ഭാഗം  അനുവദിക്കാമോ, പാടില്ലയോ എന്നാണ് ഇനി ആലോചിക്കുവാനുള്ളത്. ഈവിഷയത്തെ ആലോചിക്കുന്നതിന് മുമ്പായി, മരുമക്കത്തായ കുഡുംബങ്ങളുടെ ഉത്ഭവത്തെപ്പററി അല്പം പ്രസ്താവിക്കുന്നത് ഉചിതമായിരിക്കുമെന്നു തോന്നുന്നു. ഒരുസ്ത്രീയും അവളുടെ പുത്രികളും പുത്രന്മാരും ആ പുത്രികളുടെ സന്താനങ്ങളും, ഇങ്ങനെ ഒരു സ്ത്രീയില്‍നിന്ന് ജനിച്ചതായിട്ടുള്ള എല്ലാ ആളുകളും ഒരു അവിഭക്ത മരുമക്കത്തായ കുഡുംബത്തില്‍ ഉള്‍പ്പെട്ടവരായിരിക്കും. ഈ കുഡുംബത്തിലുള്ള എല്ലാ ആളുകളും ഒരേ വീട്ടില്‍ താമസിക്കണമെന്നും, ഈ കുഡുംബം വകയായുള്ള വസ്തുക്കള്‍ക്കെല്ലാം ആ കുഡുംബത്തിലുള്ള എല്ലാആളുകള്‍ക്കും തുല്യ അവകാശമുണ്ടായിരിക്കുമെന്നും, എന്നാല്‍, ഒരുത്തര്‍ക്കും പ്രത്യേകം ഓഹരി ചോദിക്കുന്നതിന് അവകാശമില്ലെന്നുമാണ് നിശ്ചയം. കുഡുംബം വകയായുള്ള വസ്തുക്കളെ കൈവശംവച്ച്. ആദായം എടുത്തുവന്നതും കുഡുംബം പരിപാലിച്ചുവന്നതും, ആ കുഡുംബത്തിലുള്ള മൂത്ത സ്ത്രീയായിരുന്നു. എന്നാല്‍, കുഡുംബം ഭരിക്കുന്നതിന് സ്ത്രീകള്‍ക്കുള്ള പ്രയാസം നിമിത്തവും, അതിലേക്കു പുരുഷന്മാര്‍ക്കുള്ള സൌകര്യം നിമിത്തവും, കുഡുംബഭരണം ചെയ്യുന്നതിനുള്ള അധികാരം ക്രമേണ മൂത്ത സ്ത്രീയെവിട്ട് ആ കുഡുംബത്തിലുള്ള മൂത്തപുരുഷന് സിദ്ധിച്ചു. ഈ മൂത്തപുരുഷനെ കാരണവര്‍ എന്നു സാധാരണയായി വിളിച്ചുവരുന്നു. കാരണവന്‍ കുഡുംബത്തിലുള്ള എല്ലാ ആളുകളേയും തുല്യമായി സ്നേഹിക്കുമെന്നും, അവരുടെയും കുഡുംബത്തിന്‍റെയും ശ്രേയസ്സിലേക്കായി എപ്പൊഴും താല്പര്യമുള്ളവനായിരിക്കുമെന്നും, വിചാരിച്ചിരുന്നു. അനന്തരവരും, കാരണവനെ വണങ്ങി കാരണവരുടെ വരുതികേട്ട് എന്നും നടന്നുകൊള്ളുമെന്നും, തങ്ങളുടെ സമ്പാദ്യങ്ങള്‍ കുഡുംബത്തില്‍ ചേര്‍ക്കുന്നതിന് എപ്പോഴും ഇഷ്ടമുള്ളവരായിരിക്കുമെന്നും, ഇങ്ങനെ കാരണവരുടെയും, അനന്തരവരുടെയും യോജിച്ചിട്ടുള്ള പ്രവൃത്തികളുടെ ഫലമായി മരുമക്കത്തായ കുഡുംബങ്ങള്‍ നാള്‍ക്കു നാള്‍ അഭിവൃദ്ധിയെ പ്രാപിച്ചുവരുമെന്നും വിചാരിക്കപ്പെട്ടിരുന്നു.

 കേരളത്തില്‍ മരുമക്കത്തായം ആദ്യമായി നടപ്പായ കാലത്തായിരിക്കണം ഇപ്രകാരം വിശ്വസിച്ചിരുന്നത്. മരുമക്കത്തായ കുഡുംബങ്ങളുടെ ഇപ്പോഴത്തെ സ്ഥിതിയെ ആലോചിക്കുന്നതായാല്‍ മേല്‍ പ്രസ്താവിച്ച വിധത്തില്‍ നിന്ന് എത്രയോ ഭേദപ്പെട്ടിരിക്കുന്നു. ഒരുസ്ത്രീയില്‍ നിന്ന് ജനിച്ചവരാണെന്നും, ഒരുഅവിഭക്ത മരുമക്കത്തായ കുഡുംബത്തില്‍ ചേര്‍ന്നവരാണെന്നും സമ്മതിക്കപ്പെടുന്നവരായ അനേകം ആളുകള്‍ പ്രത്യേകം പ്രത്യേകം അനേകം ഭവനങ്ങളിലായി താമസിച്ചു വരുന്നതു വളരെ സാധാരണയായിരിക്കുന്നു. ഒരേ കുഡുംബത്തില്‍ ഒരുമിച്ചു താമസിക്കുന്നതിന് നിശ്ചയിക്കപ്പെട്ടിരുന്ന അനേകം ആളുകള്‍ അനേകം സ്ഥലങ്ങളിലായി ഇപ്പോള്‍ താമസിച്ചു വരുന്നതിന്‍റെ കാരണം എന്തായിരിക്കും എന്നന്വേഷിച്ചറിയേണ്ട സംഗതി അത്രവളരേ ആളുകള്‍ക്ക് ഒരുമിച്ചു താമസിക്കുന്നതിന് വേണ്ടുവോളം സ്ഥലം ഒരുവീട്ടില്‍ സാധാരണയായി ഉണ്ടായിരിക്കയില്ലാ എന്നതായിരിക്കും വ്യക്തമായ കാരണം. കുഡുംബത്തിലുള്ള ഉപശാഖകള്‍ അകന്നുവരുംതോറും, അവ തമ്മിലുള്ള സ്നേഹവും ക്രമേണ കുറയുകയും അതുനിമിത്തം പ്രത്യേകം താമസമാക്കുന്നത് ഇരുശാഖക്കാര്‍ക്കും സന്തോഷമായിരിക്കയും ചെയ്യും എന്നുള്ളത് മറ്റൊരു കാരണമാണ്. ഇതുകൂടാതെ അനേകം സ്ഥലങ്ങളില്‍ വസ്തുക്കളുള്ള ഒരു കുഡുംബം പരിപാലിച്ചുകൊണ്ട് പോകുന്നതിന് ഒരു കാരണവര്‍ക്ക് സ്ഥിതി പോരാതെ വരുമ്പോള്‍ ഓരോ വീട്ടിലും തന്‍റെ കുടുംബത്തിലുള്ളവരെ കൊണ്ടുചെന്നു താമസിപ്പിക്കുകയും വീടുകള്‍ക്ക് സമീപമുള്ള കുഡുംബവകയായുള്ള വസ്തുക്കളെ **************കാലക്ഷേപം ചെയ്തുകൊള്ളുന്നതിന് കാരണവന്മാര്‍ തന്നെ ***************** കാരണങ്ങള്‍ എന്തു തന്നെയായാലും ഒരു കുടുംബത്തിലുള്ള എല്ലാ ആളുകളും ഒരുമിച്ചു താമസിച്ചു വരുന്നു എന്നുള്ളത് സുപ്രസിദ്ധമാണ്. 

ഇങ്ങനെ താമസിച്ചുവരുന്ന ഒരേ കുടുംബത്തിലുള്ള അനേകം ആളുകള്‍ തങ്ങളുടെ അവിഭക്തകുടുംബത്തിലെ കാരണവനെ ദിവസവും കാണുന്നതിനുപോലും ചിലപ്പോള്‍ സാധിക്കായ്ക നിമിത്തം അവരവര്‍ താമസിക്കുന്ന വീടുകളിലുള്ള പുരുഷന്‍റെ വരുതികേട്ട് അയാളെ കാരണവനെപ്പോലെ വിചാരിച്ച് നടന്നുവരുന്നു. കാരണവരുടെ ജോലിക്കും ഇത് ഒരു വലിയ സഹായമായി തീര്‍ന്നതിനാല്‍ കാരണവരും ഈ കാര്യത്തില്‍ അത്ര ശ്രദ്ധ വയ്ക്കാറില്ലാ. ഇതു നിമിത്തം കുടുംബത്തിലുള്ള എല്ലാ ഇളമുറക്കാരെയും ഒരുപോലെ സ്നേഹിക്കുമെന്നും മററും ഊഹിക്കപ്പെട്ടിരുന്നതായ കാരണവന്‍ തന്നോടുകൂടെ താമസിക്കുന്നവരും തന്‍റെ വരുതികേട്ട് നടക്കുന്നവരും ആയ അനന്തരവരെ, മററു ശാഖക്കാരേക്കാള്‍ കൂടുതലായി സ്നേഹിക്കുന്നതിനും, അവരുടെ വസ്തു വര്‍ദ്ധിപ്പിക്കുന്നതിനും, വേണ്ടിവന്നാല്‍ മററ് ശാഖക്കാരരെ ഉപദ്രവിക്കുന്നതിനും മനസ്സുള്ളവനായി തീരുന്നതിന് ഇടയാകുന്നു. അനന്തരവരും അതുപോലെതന്നെ തങ്ങളെ സ്നേഹിക്കുന്ന ആളുകള്‍ക്കുവേണ്ടി പ്രയത്നപ്പെടുന്നതിനുമാത്രം മനസ്സുള്ളവരായും, കാരണവനെ സ്നേഹിക്കകയും ബഹുമാനിക്കുകയും ചെയ്യാത്തവരായും തീരുന്നു. കാരണവരും അനന്തരവരും തമ്മില്‍ ഈവിധം വിരോധപ്പെട്ടിരിക്കുന്നതായ മരുമക്കത്തായ കുടുംബങ്ങള്‍ അനേകം ഉണ്ട്. ഇങ്ങനെ പ്രത്യേകം താമസിക്കുന്നവരായ അനേകം ശാഖകളില്‍ ചിലതില്‍ ആളുകള്‍ വര്‍ദ്ധിക്കുക നിമിത്തം അവര്‍ക്ക് ലഭിച്ചതായ കുടുംബസ്വത്തുകൊണ്ട് കാലക്ഷേപത്തിനു പോലും മതിയാകാതെയും മററ് ശാഖകളില്‍ ആളില്ലാതെ വരുകനിമിത്തം ആവശ്യമുള്ളതിലധികം സ്വത്ത് അവരുടെ കൈവശം ഇരിക്കുന്നതായും വരുമ്പോള്‍, ഓരോ ശാഖക്കാര്‍ക്കും തമ്മില്‍ വിരോധപ്പെടുന്നതിന് പ്രത്യേക കാരണം അന്വേഷിക്കേണ്ടാ. ഓരോ ശാഖക്കാര്‍ക്കും ചെലവിനുകൊടുത്തതായ വസ്തുക്കളെ ആവശ്യംപോലെ കൂടുതല്‍ കുറവുചെയ്യുന്നതിന് കാരണവര്‍ക്കു അധികാരം ഉണ്ടെന്ന് കോടതികള്‍ സ്ഥാപിച്ചിട്ടുണ്ടെന്നുവരുകിലും, ഈ അധികാരത്തെ നടത്തുന്നതിന് കാരണവര്‍ പുറപ്പെടുമ്പോളാണ് കാരണവരും ഇളമുറക്കാരരും തമ്മില്‍ രാമരാവണയുദ്ധത്തിനേക്കാള്‍ വലുതായ യുദ്ധം ഉണ്ടാകുന്നത്. ഇങ്ങനെ പ്രത്യേകം വീടുകളില്‍ താമസിച്ചുവരുന്ന ശാഖക്കാര്‍ 30 കൊല്ലത്തോളം പ്രത്യേകം താമസിച്ചും, അവരവരുടെ കാര്യാദികള്‍ അന്വേഷിച്ചും വസ്തുസമ്പാദിച്ചും, വേണ്ടിവന്നാല്‍ വസ്തുക്കള്‍ അന്ന്യാധീനംചെയ്തും ഇരിക്കുമ്പോള്‍, ആ ശാഖക്കാര്‍ തമ്മില്‍ ഭാഗതുല്യമായ വേര്‍പാട് സംഭവിച്ചിരിക്കുന്നതായി കോടതികള്‍ തീരുമാനിക്കയും ചെയ്യാം.

 മലയാളകുടുംബങ്ങളില്‍ കാരണവരും ഇളമുറക്കാരും തമ്മില്‍ ഇഷ്ടമില്ലാതെ ഇരിക്കുന്നതിനുള്ള മുഖ്യകാരണം അവരുടെ ഇടയില്‍ ഭാഗംചോദിക്കുന്നതിന് കുടുംബത്തിലുള്ള ആര്‍ക്കുംതന്നെ അവകാശമില്ലെന്നുള്ളതാണെന്ന് ഞാന്‍ വിചാരിക്കുന്നു. കുടുംബത്തിലുള്ള സകല വസ്തുക്കളും കാരണവരുടെ കൈവശം ഇരിക്കേണമെന്ന് നിര്‍ബന്ധിക്കുന്നതിന് ഇപ്പോള്‍ കാരണവര്‍ക്ക് അവകാശം ഉണ്ട്. കാരണവരുടെ കൈവശംവിട്ട് അനന്തരവരുടെ കൈവശം പോകുന്നതായ വസ്തുക്കളെ വീണ്ടെടുക്കുന്നതിന് സിവില്‍ വ്യവഹാരംകൂടാതെ സാധാരണയായി സാധിക്കുന്നില്ലാ. അതിനാല്‍, കുടുംബവസ്തുക്കളെ ഇളമുറക്കാരരെ ഏല്‍പ്പിക്കുന്നതിന് കാരണവര്‍ മനസ്സില്ലാത്തവനായും തീരുന്നു. പണം സമ്പാദിക്കണമെന്ന് ആഗ്രഹമുള്ള അനന്തരവര്‍ക്ക് കച്ചവടമോ കൈത്തൊഴിലോ കൃഷിയോ ചെയ്ത് പണം സമ്പാദിക്കുന്നതിന് അനന്തരവര്‍ക്കും അവകാശമുള്ളതായ അവരുടെ കുടുംബസ്വത്ത് ഉപയോഗപ്പെടുന്നതല്ലാ. ഈവിധമുള്ള ഏതെങ്കിലുംകാര്യങ്ങള്‍ക്ക് ഒരു ഇളമുറക്കാരന് സഹായം ചെയ്യുന്നതിനായി, ഒരു കാരണവന്‍ പുറപ്പെടുന്നതായാല്‍, ശേഷമുള്ള എല്ലാ അനന്തരവരും ആ കാരണവരെ കുടുംബദോഷിയായി ഗണിച്ച് സ്ഥാനത്തുനിന്ന് നീക്കംചെയ്യുന്നതിനായി പുറപ്പെടും. കാരണവര്‍ കുടുംബത്തിലുള്ള എല്ലാ ആളുകളേയും ഒരുപോലെ വിചാരിക്കേണ്ടതിനാലും, എല്ലാ അനന്തരവര്‍ക്കും മേല്‍ പറഞ്ഞവിധം സഹായിക്കുന്നതിന് എല്ലാ മരുമക്കത്തായ കുടുംബങ്ങളിലും വേണ്ട ധനം ഉണ്ടായിരിക്കാത്തതിനാലും, കാരണവന്മാര്‍ മേല്‍പറഞ്ഞവിധമൊന്നും പ്രവര്‍ത്തിച്ചുകാണാറില്ലാ. ഇതുകൂടാതെയും, കച്ചവടം മുതലായവയില്‍ പ്രവേശിച്ച്, പണം സമ്പാദിക്കുന്നതിന് മൂലധനവും പ്രത്യേകം വിദ്യാഭ്യാസവും ആവശ്യമാണ്. ഇതിലേക്കും കുടുംബങ്ങളില്‍നിന്ന് സാധാരണയായി സഹായംചെയ്തു കാണാറില്ലാ. സര്‍ക്കാര്‍ ഉദ്യോഗം ലഭിക്കാന്‍ വേണ്ട വിദ്യാഭ്യാസം ചെയ്യിക്കുന്നതിന് ചില കാരണവന്മാര്‍ സഹായം ചെയ്തു കണ്ടിട്ടുമുണ്ട്. മേല്‍പ്പറഞ്ഞ കാരണങ്ങളാല്‍ മരുമക്കത്തായ കുടുംബങ്ങളിലുള്ള അനന്തരവര്‍ക്ക് പണം സമ്പാദിക്കുന്നതിന് കൂലിവേലയല്ലാതെ വേറെ മാര്‍ഗ്ഗം മരുമക്കത്തായ നിയമപ്രകാരം അനുവദിച്ചിട്ടുണ്ടോ എന്ന് സംശയിക്കേണ്ടിയിരിക്കുന്നു.                           (തുടരും)

Marumakkathaya Family Division

What is to be considered now is whether a partition can be allowed in the Marumakkathaya families or not. Before considering this subject, it seems appropriate to state a little about the origin of the Marumakkathaya families. All individuals born to a woman, which includes the woman, her daughters and sons, and the offspring of those daughters, belong to one undivided Marumakkathayam family. It is an accepted norm that all members of this family shall live in the same house, and all the members of this family shall have equal rights to all the property belonging to it, but no one shall have the right to ask for a separate share. It was the eldest woman in the family who took the income from the property and looked after the entire family. However, due to the difficulty for women to oversee and maintain the family, and due to the convenience for men to do so, the authority to rule the family gradually changed hands from the elder woman to the elder man in the family. This elder male member is usually called the Karanavar. He was supposed to love and treat all the people in the family equally and to always be interested in the welfare of the family. It was accepted that the nephews would always be obedient to the Karanavar, and would always be willing to add their earnings to the family assets, and thus, as a result of the concerted actions of the Karanavar and the nephews, the families would prosper day by day.

This must have been the belief at a time when Marumakkathayam started to be practiced in Kerala. If we consider the present situation of Marumakkathaya families, it can be seen to be much different from the way it was when it began. It is very common for many people who are admitted to be born of one woman and belong to an undivided kinship family, living in several separate houses now.

The reason why so many people who were destined to live together in the same family house are now living in many different places is to be investigated. The obvious reason is that there is usually not enough space in one house for so many people to live together. Another reason is that as the sub-branches of the family grow further apart, the bond between them decreases gradually and hence the branches will be happy to live separately. In addition to this, when the Karanavar cannot properly maintain the properties scattered over different locations, he decides to house sub-branches of the family in separate houses, whereby their family members can spend time on the family property near the houses.

***** Whatever the reason may be, it is a well-known fact that all the people in a sub-family stay together. Many people in the same family living in different houses sometimes do not even see the Karanavar of the undivided family every day. So, they accept and treat the eldest man in their particular houses as the Karanavar. As this has become a great help to the Karanavar in carrying out his daily routine, he does not pay much attention to this matter. Because of this, the Karanavar who is expected to love all the younger members of the undivided family equally, usually tends to love the descendants who live with him and follow in his footsteps more than members of the other branches and tries to increase their property, and if need be, to even harm the other branches. The nephews, likewise, end up willing to strive only for those who love them, and not loving and honouring the Karanavar. There are many Marumakkathaya families where there is great animosity between the Karanavar and the descendants. In some of the branches that are living separately, due to the increase in their numbers, the income from the family property received by them is not even enough to meet their expenses. At the same time, in some other branches, due to their lesser number, they have more property in their possession and income than what is necessary. Even though the courts have established that the Karanavar has the power to further reduce the extent of property given to each branch as needed, when he sets out to exercise that power, a battle more furious than the battle of Ram and Ravana erupts between the Karanavar and the younger generations. When the members of the sub-branches live in separate houses for 30 years, fending for their own necessities and acquiring property, and if necessary, expending such property, the courts can decide that there has been a partial separation between those sub-branches.

I think that the main reason for the lack of love between the elders and the younger generation in the families is that no one in the family has the right to demand for a partition of the property between them.

The Karanavar now has the right to insist that all such family property is in his possession. It is usually not possible to recover property that has been passed on from the estate to the heirs without civil litigation. Hence, the Karanavar becomes reluctant to hand over family assets to younger generations.

Descendants who wish to earn a living through trade, agriculture, or manual labor are not allowed to use their family property for the purpose. If a Karanarvar goes out to help a younger person in any of these matters, all the others in the family will unite to remove him by accusing him as a family traitor.

Because Karanavars have to treat all the people in the family equally, and because not all families have enough money to support all the descendants in the same way, the Karanavars are not seen helping the dependents. Besides, one has to have capital and special education to earn money by entering into business and the like. In such cases too, families usually do not help. Some Karanavars, however, were seen to have helped the dependents in getting the education needed to get a government job. Due to the above reasons, it is doubtful whether any means of earning money other than toiling on daily wage labour is allowed under the Marumakkathayam laws.
